LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION

March 24, 2013

TO:
Honorable Jane Nelson, Chair, Senate Committee on Health & Human Services

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
SB502 by West (Relating to placement of children with certain relatives or other designated caregivers.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Family Code as it relates to the procedures for the placement of children with certain relatives or other designated caregivers.

Under current law, DFPS is required to pay a caregiver on the initial placement of a child or sibling group a one-time cash payment of not more than $1,000. The bill would allow the Department of Family and Protective Services (DFPS) to pay a caregiver on the initial placement of a child up to $1,000 per child and a minimum of $1,000 for each sibling group, but the payment may not exceed $1,000 per child.  The cost of this provision could be significant if the agency took action to increase payments to the maximum amount per child.

The bill would apply only to the placement of a child for whom DFPS is named managing conservator on or after the effective date of this bill.

The bill would take effect September 1, 2013.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
