LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION

March 22, 2013

TO:
Honorable John Carona, Chair, Senate Committee on Business & Commerce

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
SB602 by Davis (Relating to retail electric provider customer choice information.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill amends the Utilities Code relating to retail electric provider customer choice information. The bill would require the Public Utility Commission (PUC) to provide access to certain complaint and enforcement data on the Power-to-Choose website, except to the extent that the information is specifically made confidential under other law, and update the information quarterly. The bill would require the PUC by rule to prescribe the manner in which the information is presented and ensure the information is easily accessible and presented in a format that does not identify customers. The bill would also require the PUC to adopt rules to require retail electric providers to submit information to the commission related to complaints and enforcement actions if the PUC requests the information.

Based on information provided by the PUC, duties and responsibilities associated with implementing the provisions of the bill could be accomplished utilizing existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
