FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
SB612 by Lucio (Relating to a drug testing requirement for candidates for certain public elective offices.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Election code to require drug testing of candidates for public office, except when the federal or state constitution or statute outside of the Election code prescribes exclusive eligibility requirements. The bill would require the Ethics Commission to release the results to the drug tests no later than the 45th day before the election. The Secretary of State and Ethics Commission indicate that any costs associated with implementing the bill could be absorbed within existing resources.

The bill would take effect September 1, 2013.

Local Government Impact

Some local entities could be financially impacted depending on the size of the entity and number of candidates. However, no significant fiscal implication to units of local government is anticipated.
