The bill would amend the Occupations Code relating to defining and establishing requirements for the regulation of energy efficiency professionals by the Texas Department of Licensing and Regulation (TDLR). The bill would require the Texas Commission of Licensing and Regulation to establish rules, regulations, licensing requirements, and fees for the license. The bill would also allow the commission to impose an administrative penalty for violations and, along with the Office of the Attorney General (OAG), institute an action for an injunction or a civil penalty.
Based on information provided by the Department of Public Safety, the Comptroller of Public Accounts, TDLR and the OAG, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources. This analysis does not consider any potential revenue gains from penalty assessments.
