TO:
Honorable Dan Patrick, Chair, Senate Committee on Education

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
SB709 by Lucio (Relating to representation of a person in a special education impartial due process hearing.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would allow a person to be represented in a due process hearing by either a licensed attorney or by a person who had special knowledge or training with respect to problems of children with disabilities and who met the qualifications established by the commissioner of education by rule.

The Texas Education Agency (TEA) would not be required to license or regulate representatives in special education impartial due process hearings.

Based on the analysis of TEA, the bill has no significant fiscal impact to the state.

Local Government Impact

No fiscal implication to units of local government is anticipated.
