No significant fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to prohibit the disposal of used computer equipment in a solid waste landfill or incinerator and would provide for the assessment of civil penalties for violation of the disposal prohibition.
 
The bill would require the Texas Commission on Environmental Quality (TCEQ) to adopt rules to prohibit a person from intentionally or knowingly disposing of computer equipment in a solid waste landfill or incinerator. Owners or operators of a municipal solid waste landfill or incinerator would be exempt from being in violation if a good faith effort is made; appropriate signs are posted; and if registered customers are notified in writing of the disposal prohibition.
 
TCEQ reported the provisions of the bill are not anticipated to have a significant fiscal impact on the agency.

Local Government Impact

There could be an increase in the quantity of computer equipment that is required to be recycled, and local governments that operate voluntary electronic recycling programs may experience an increase in costs of managing collection activities; however, those amounts would vary depending on the number of recycling programs in an area and the costs for recycling electronics.
