No significant fiscal implication to the State is anticipated.

The bill would prohibit the Texas Education Agency (TEA) from adopting a performance standard for students receiving special education services that indicated that the student did not meet standards if the admission, review, and dismissal (ARD) committee determined that the lowest level of an assessment accurately represented the student's developmental level.

This bill has no direct fiscal implications for the Foundation School Program (FSP) and no significant impact on the operations of the TEA. The commissioner of education has the authority to set the performance standards on assessments, and the TEA has sufficient input from the original standard-setting committees to make any necessary adjustments to the performance standards.
