LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION

March 21, 2013

TO:
Honorable Bob Deuell, Chair, Senate Committee On Economic Development

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
SB920 by Eltife (Relating to the requirement that an unemployed individual be actively seeking work to be eligible for unemployment compensation benefits.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Labor Code to add the requirement that an unemployed individual be actively seeking work to be eligible for unemployment compensation benefits.

Based on information provided by the Texas Workforce Commission (TWC), it is assumed that duties and responsibilities necessary to implement the provisions of the bill could be accomplished within existing resources.

In addition, TWC reports that the United States Department of Labor issued an informal opinion that the bill conforms to federal law with the newly added work search requirement required under the Social Security Act, Section 303(a)(12).  Nonconformity with the federal law could result in significant negative fiscal impacts to the State including proceedings to deny certifying the State as eligible to receive federal grants for the administration of the State Unemployment Compensation law.

Local Government Impact

No fiscal implication to units of local government is anticipated.
