No significant fiscal implication to the State is anticipated.
The bill would amend the Penal Code to specify that subject to existing statutory requirements, it is not a defense to a prosecution for burglary that the actor is attempting to take ownership of property through an adverse possession claim. It is not anticipated that the bill would result in any significant fiscal impact to the court system. The bill would take effect September 1, 2013.
