SB965 by Williams (Relating to the correction of employment termination reports for law enforcement officers.), Committee Report 2nd House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Occupations Code relating to the correction of employment termination reports for law enforcement officers.  The bill would require the Texas Commission on Law Enforcement Standards and Education (TCLEOSE) to change the original employment termination report upon a finding by an administrative law judge that the alleged misconduct cited in the report was not supported by the preponderance of the evidence.  The bill would direct TCLEOSE to send the changed employment termination report to the law enforcement agency that prepared the original employment termination report. The bill would require the law enforcement agency to replace the original employment termination report with the changed report.

Based on information provided by State Office of Administrative Hearings, Commission on Law Enforcement Officer Standards, and the Comptroller of Public Accounts, it is assumed that the provisions of the bill could be implemented within existing resources. The bill would take effect September 1, 2013.
