LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION

April 23, 2013

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
SB969 by West (Relating to the electronic recording and admissibility of certain statements made by an accused as a result of custodial interrogation.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure to prohibit the admissibility of a written statement of an accused person without an electronic recording of the custodial interrogation. The bill also contains provisions regarding identification of persons involved in and the preservation of the electronic recording. The bill would take effect September 1, 2013. The Office of Court Administration does not anticipate a significant fiscal impact to the court system resulting from the bill. This analysis assumes the bill would not result in a significant fiscal impact to the state.

Local Government Impact

Some local law enforcement agencies may need to expend funds for new recording equipment; however, fiscal impact is not expected to be significant.
