The bill would amend the Occupations Code and Health and Safety Code relating to the repeal of certain offenses relating to certain occupations regulated by the Texas Department of Licensing and Regulation.
Based on information provided by the Department of Licensing and Regulation, the Office of the Attorney General, and the State Office of Administrative Hearings, this analysis assumes that duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
The bill would repeal the penalties for violating regulatory statute licensing elevator inspection, leasing services, common labor, property appraisal, tax consultation, combative sports, industrialized housing, barber inspection, and cosmetology inspection. The penalties for these violations are varying degrees of misdemeanors.
Removing these penalties would simultaneously reduce workload in local courts and reduce fines collected from offenders. The fiscal impact to units of local government would vary depending on the number of cases that would otherwise be prosecuted, but this is not anticipated to be significant.
