No significant fiscal implication to the State is anticipated.

The bill would require school districts that permit corporal punishment to report in the Public Education Information Management System (PEIMS) each instance of the use of corporal punishment during the period covered by the submission. Each instance must include the student's age, sex, race or ethnicity, and eligibility to receive special education services, and must comply with the Family Educational Rights and Privacy Act (FERPA). 
 
The bill would require school districts to report annually to the Texas Education Agency (TEA) the incidence of citations, defined as a ticket issued for a Class C misdemeanor, issued to students.
 
To implement the bill, TEA would have to add new data elements for corporal punishment and citations to PEIMS. The agency would also be required to develop reports based on these data and make them available to the public. 

Based on the analysis of TEA, the duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

Local Government Impact

School districts are already required to report certain disciplinary actions, not including corporal punishment and the issuance of citations, to TEA. They would now be required report these additional disciplinary actions to TEA. 
 
The administrative costs are not anticipated to be significant, but could vary from school district to school district depending on whether the local student information software was locally developed or vendor developed.
