No significant fiscal implication to the State is anticipated.

The bill would amend the Finance Code and Government Code relating to identity recovery service contracts.

Based on information provided by the Department of Licensing and Regulation (TDLR), Office of the Attorney General, and the Comptroller of Public Accounts, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

The bill would repeal Chapter 1306 of the Occupations Code, regarding identity recovery service contract providers and administrators, which includes a requirement that a provider must pay to the Texas Department of Licensing and Regulation a $1 fee for each identity recovery service contract sold or issued.  The bill would amend Chapter 1304 of the Occupations Code, regarding service contract providers and administrators, to add the same requirement for a $1 fee for each identity recovery service contract sold or issued.
