No significant fiscal implication to the State is anticipated.

The bill would require the Texas Education Agency (TEA) to develop procedures for awarding partial credit to students who are in the conservatorship of the Department of Family and Protective Services (DFPS) for course work that a student in substitute care completed while enrolled at another school.

The bill would add to the list of absences excused for state funding purposes an absence of a student in DFPS conservatorship in order to participate in a court-ordered activity related to child protection or review of placement. Excused days would include days for travel.

The Texas Education Agency indicates that the duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resouces. The bill provisions creating an additional absence that would be excused for state funding purposes would have no identifiable effect on the Foundation School Program.

Local Government Impact

A school district that excused the absence of a student in DFPS conservatorship for a court-ordered activity would be able to count the student in attendance for state funding purposes.
