LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 83RD LEGISLATIVE REGULAR SESSION

April 26, 2013

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
SB1522 by Hegar (Relating to the procedures applicable to the revocation of a person's release on parole or to mandatory supervision. ), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code relating to the procedures applicable to the revocation of a person's release on parole or mandatory supervision. Under the bill's provisions, criteria are modified for when a releasee is issued a summons to appear for a revocation hearing, instead of the issuance of a warrant. The bill would also prohibit a releasee, that is appearing at a hearing in response to a summons, from being held in a county jail without the consent of the sheriff of the applicable county. The Texas Department of Criminal Justice and the Board of Pardons and Paroles have determined the bill would not result in a significant fiscal impact to the State. The bill would take effect September 1, 2013.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
