No significant fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code and repeal Subchapter B, Chapter 573 of the Health and Safety Code and certain sections of the Government Code relating to the emergency detention of persons with mental illness. The bill would amend the options available to a physician, the notifications that must occur when a person is under emergency detention, and require the entry of certain information into the patient's clinical record. The bill removes the issuance of warrants by magistrates for persons in need of emergency detention. Based on the analysis provided by the Department of State Health Services and the Office of Court Administration, it is assumed that the provisions of the bill can be implemented within existing resources.
