No significant fiscal implication to the State is anticipated.
The bill would amend Chapter 181 of the Health and Safety Code relating to the training of employees of certain covered entities. The bill would require certain entities to provide training concerning protected health information as necessary and appropriate for employees to carry out their job duties. The bill would require the training to occur within 90 days after hire and requires a retraining within the first anniversary of the date the material change to state or federal privacy laws takes effect if such a change does affect the duties of the employees. The bill would take effect immediately if a two-thirds majority vote in both houses of the Legislature is received. Otherwise, the bill would take effect on September 1, 2013. Based on the analysis provided by the Department of State Health Services, it is assumed that the provisions of the bill can be implemented within existing resources.
