No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to direct the Department of Public Safety (DPS) to establish a process to enable individuals who possess a valid concealed handgun license (CHL) to obtain a school safety training certification. The bill would authorize qualified handgun instructors certified in school safety to provide school safety training to employees of an Independent School District or open-enrollment charter school who possess a valid CHL. The bill would allow DPS to create and adopt rules to implement the provisions of the bill. The bill would direct DPS to establish a fee sufficient to cover the costs of the school safety certification. While the agency has stated the number of CHL instructors who would choose to obtain a school safety certification is indeterminate, the agency assumes the fee revenue required by the bill would offset the costs of implementing the provisions of the bill. The bill would take effect September 1, 2013.


Local Government Impact

It is assumed that an Independent School District or open-enrollment charter school who opts to send certain of their staff to receive school safety training offered by an instructor who is certified according to the provisions of the bill would be able to absorb the costs associated with the training.
