No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code, Chapter 552, relating to information requests by legislative members. The bill would require governmental entities to provide prompt responses to the requesting legislative member and an explanation in writing to the requestor if the governmental entity is unable to respond within 10 business days. The bill would require that a governmental entity receiving a legislative request to provide information as it becomes available.

The bill takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If the bill does not receive the vote necessary for immediate effect, it takes effect September 1, 2013.

Multiple agencies including the Office of Attorney General, the Health and Human Services Commission, the Office of Court Administration, the Department of Information Resources, the Department of Public Safety, and the Public Utility Commission anticipate any additional work resulting from the passage of the bill could be reasonably absorbed within current resources. Institutions of higher education including the Texas A&M University System, the Texas Tech University System and the University of Texas System anticipate any additional work resulting from the passage of the bill could be reasonably absorbed within current resources.


Local Government Impact

No significant fiscal implication to units of local government is anticipated.
