LEGISLATIVE BUDGET BOARD
Austin, Texas

CRIMINAL JUSTICE IMPACT STATEMENT

83RD LEGISLATIVE REGULAR SESSION

March 11, 2013

TO:
Honorable Abel Herrero, Chair, House Committee On Criminal Jurisprudence

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB220 by Price (Relating to consecutive sentences for certain offenses involving injury to a child, an elderly individual, or a disabled individual and arising out of the same criminal episode.), As Introduced

The bill would amend the Penal Code by allowing for the concurrent or consecutive serving of sentences for certain serious cases of the offense of injury to a child, elderly individual, or disabled individual. The bill would take effect on September 1, 2013, and only applies to offenses committed on or after that date.

In fiscal year 2012, six individuals were admitted to the Texas Department of Criminal Justice for offenses affected by the bill's provisions.  Therefore, in the case of the bill, it is assumed that the number of offenders supervised or incarcerated under this statute would not significantly impact state correctional agencies' workload and programs.
