The bill would amend the Government Code as it relates to the eligibility of inmates convicted of certain intoxication offenses for release on parole or mandatory supervision. The provisions of the bill would apply to inmates serving a sentence of 25 years or more for certain intoxication offenses. The bill's provisions would not allow these offenders to be released to mandatory supervision and would only allow them to be released to parole supervision once inmates' actual time served (without consideration of good conduct time) equals one-half of the sentence or 30 calendar years, whichever is less, but no less than two calendar years.
 
The bill increases the length of incarceration for certain inmates convicted of certain intoxication offenses. Increasing the length of incarceration for any criminal offense is expected to increase demands on state correctional resources. Under the provisions of the bill, it is expected that any increase offenders' length of incarceration would not significantly impact state correctional agencies' workload and programs within the first five years of the bill's implementation. In subsequent years, the bill's fiscal impact may increase as additional offenders are subject to the bill's provisions; this is dependent on the frequency with which the penalty is employed. In fiscal year 2012, 102 offenders were admitted to Texas Department of Criminal Justice (TDCJ) facilities. Based on the release patterns of similar offenders released from TDCJ facilities in fiscal year 2012, the length of incarceration would only increase for 45 of these admissions within the first five years of implementation.
