HB529 by Turner, Sylvester (Relating to the detention of juveniles pending criminal trial.), As Introduced

The bill would amend the Family Code, Human Resources Code, and the Code of Criminal Procedure to require juveniles certified as an adult who are under the age of 17 to be held in a juvenile detention facility pending trial.  Under current law a juvenile board must establish a policy as to whether or not they intend to require juveniles to be held in a juvenile detention facility under those circumstances.  The bill repeals the section of the Human Resources Code requiring a juvenile board to establish a policy for these circumstances.  The bill also amends the Code of Criminal Procedure to allow a judge to hold a hearing to determine whether a juvenile detained in a juvenile detention facility under these circumstances should be transferred to an adult facility.

 

No significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies is anticipated from any provisions of this bill that authorize or require a change in the sanctions applicable to juveniles who have been adjudicated for misdemeanor or felony conduct.  In fiscal year 2012, a total of 164 juveniles were certified as an adult.
