The bill would amend the Penal Code as it relates to the carrying of concealed handguns by certain license holders on certain locations associated with a public or private school or educational institution. Under the provisions of the bill, being a concealed handgun license holder would be a defense to prosecution for carrying a concealed handgun in places where a weapon is prohibited. 

A felony of the third degree is punishable by confinement in prison for a term from 2 to 10 years and, in addition to confinement, an optional fine not to exceed $10,000.

The impact of the bill on correctional populations would depend on how many fewer persons would be prosecuted under the proposed statute compared to existing statute. In fiscal year 2012, there were 630 arrests, 47 were placed under felony community supervision, and 12 were admitted to prison for the offense of carrying a weapon in places where weapons are prohibited. It is assumed that the reduction in the number of offenders supervised or incarcerated under this statute would not significantly impact state correctional agency resources.
