LEGISLATIVE BUDGET BOARD
Austin, Texas

CRIMINAL JUSTICE IMPACT STATEMENT

83RD LEGISLATIVE REGULAR SESSION

March 21, 2013

TO:
Honorable Mike Villarreal, Chair, House Committee On Investments & Financial Services

FROM:
Ursula Parks, Director, Legislative Budget Board

IN RE:
HB2758 by Anderson (Relating to the business, supervision, and regulation of state savings and loan associations and state savings banks; providing a criminal penalty.), As Introduced

The provisions of the bill that are the subject of this analysis would amend the Finance Code relating to the offense of criminal slander or libel related to a savings bank.  Under the provisions of the bill, the penalty for both offenses would be punishable as a state jail felony.

A state jail felony is punishable by confinement in a state jail for a term from 180 days to 2 years and, in addition to confinement, an optional fine not to exceed $10,000 or Class A Misdemeanor punishment (mandatory post conviction community supervision).

It is assumed that the number of offenders supervised or incarcerated under this statute would not significantly impact state correctional agency resources. In fiscal year 2012, there were less than 10 arrests, no misdemeanor community supervision placements, and less than 10 admissions to the Texas Department of Criminal Justice for slander against a savings and loan association.
