SB511 by Whitmire (Relating to the commitment of certain juveniles to local post-adjudication secure correctional facilities in certain counties and to the release under supervision of those juveniles.), Committee Report 2nd House, Substituted

The bill would amend the Family Code and Human Resources Code to allow a juvenile court in a county in which the juvenile board or local juvenile probation department operates or contracts for the operation of a post-adjudication secure correctional facility and which has a population of more than one million and less than 1.5 million to commit juveniles adjudicated for a felony offense to their local post-adjudication secure correctional facility.   The bill would also authorize a local juvenile probation department affected by the bill to provide parole supervision for juveniles committed to and released from a local post adjudication secure correctional facility under this statute.  The bill would take effect on December 1, 2013, and expire on December 31, 2018.
 
Based on the 2010 U.S. Census, Travis County is the only county with a population of more than one million and less than 1.5 million.  The impact of the bill would depend on the extent to which the juvenile court in Travis County chooses to commit juveniles to their local post-adjudication secure correctional facility as opposed to the Texas Juvenile Justice Department (TJJD).  In fiscal year 2012, a total of 11 juveniles were committed to TJJD from Travis County.  No significant impact on the programs and workload of state corrections agencies or on the demand for resources and services of those agencies is anticipated from any provisions of this bill that authorize or require a change in the sanctions applicable to juveniles who have been adjudicated for felony conduct.
