Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Education was held on Thursday, February 21, 2013, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 9:05 AM. There being a quorum present, the following business was transacted:

 

 Other Senators attending: Senator Wendy Davis.

 

The chair laid out SB 306 and recognized Senator Donna Campbell, in the absence of the author, to explain the bill.  Senator Donna Campbell sent up a committee substitute; the chair recognized Senator Donna Campbell to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.

Senator Donna Campbell moved adoption of the committee substitute; without objection, it was so ordered.  Senator Donna Campbell moved that SB 306 do not pass but that CSSB 306 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.  Senator Donna Campbell moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.     

 

At 9:20 AM Senator Robert Duncan assumed the chair.

 

The chair laid out SB 2 and recognized the author, Senator Dan Patrick, to explain the bill.  Senator Dan Patrick sent up Committee Amendment 1 and explained the amendment.  Witnesses testifying and registering on the bill are shown on the attached list. 

 

At 10:35 AM Senator Larry Taylor assumed the chair.

 

At 10:36 AM Senator Robert Duncan assumed the chair.

 

The chair moved that the testimony be closed; without objection, it was so ordered.

 

Senator Robert Duncan moved that SB 2 be left pending; without objection, it was so ordered.

 

At 12:00 PM Senator Dan Patrick resumed the chair.

 

Senator Dan Patrick moved that the committee stand recessed until 2:00 PM; without objection, it was so ordered.

 

Senator Robert Duncan reconvened the meeting at 2:00 PM.

 

As a matter of pending business, the chair resumed testimony on SB 2. Witnesses testifying and registering on the bill are shown on the attached list.

 

At 2:03 PM Senator Leticia Van de Putte assumed the chair.

 

At 3:42 PM Senator Larry Taylor assumed the chair.

 

At 3:45 PM Senator Leticia Van de Putte assumed the chair.

 

The chair moved that the public testimony on SB 2 be closed; without objection, it was so ordered.

 

At 3:58 PM Senator Dan Patrick resumed the chair.

 

Senator Leticia Van de Putte requested unanimous consent to be shown voting aye on SB 306; there being no objection, it was so ordered.

 

Senator Royce West requested unanimous consent to be shown voting aye on SB 306; there being no objection, it was so ordered.

 

There being no further business, at 4:00 PM Senator Dan Patrick moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
