Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Education was held on Tuesday, March 12, 2013, in the Capitol Extension, Room E1.028, at Austin, Texas.

Pursuant to the suspension of Senate Rules 11.10 and 11.18 during the Senate session of

March 11th, 2013, the chair considered the following bill, SB 1724.

 

The chair called the meeting to order at 8:33 AM. There being a quorum present, the following business was transacted:

As a matter of pending business, the chair laid out SB 132.  Senator Eddie Lucio, Jr. moved that SB 132 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 0 absent.  Senator Kel Seliger moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.   

 

As a matter of pending business, the chair laid out SB 172.  Senator Royce West moved that SB 172 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 0 absent.  Senator Royce West moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

As a matter of pending business, the chair laid out SB 401.  Senator Eddie Lucio, Jr. moved adoption of the committee substitute previously sent up on Tuesday, March 5, 2013; without objection, it was so ordered.  Senator Eddie Lucio, Jr. moved that SB 401 do not pass but that CSSB 401 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 0 absent.  Senator Robert Duncan moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

As a matter of pending business, the chair laid out SB 521.  Senator Ken Paxton moved adoption of the committee substitute previously sent up on Tuesday, March 5, 2013; without objection, it was so ordered.  Senator Ken Paxton moved that SB 521 do not pass but that CSSB 521 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 2 nays, 0 present not voting, and 0 absent.

 

As a matter of pending business, the chair laid out SB 715.  Senator Eddie Lucio, Jr. moved that SB 715 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 0 absent.  Senator Eddie Lucio, Jr. moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.  

 

At 8:46 AM Senator Eddie Lucio, Jr. assumed the chair.

 

As a matter of pending business, the chair laid out SB 573.  Senator Dan Patrick moved that SB 573 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 2 nays, 0 present not voting, and 0 absent.  

 

The chair laid out SB 1724 and recognized the author, Senator Patrick, to explain the bill.  Senator Dan Patrick sent up a committee substitute; the chair recognized Senator Dan Patrick to explain the difference between the committee substitute and the senate bill as filed. Senator Dan Patrick moved adoption of the committee substitute; without objection, it was so ordered.  Invited witnesses testifying and registering on the bill are shown on the attached list.

 

At 9:00 AM Senator Robert Duncan assumed the chair. 

 

At 9:08 AM Senator Kel Seliger assumed the chair.

 

At 9:09 AM Senator Robert Duncan assumed the chair.

 

The chair moved that the invited testimony be closed; without objection, it was so ordered.  

 

There being no further business, at 10:58 AM Senator Duncan moved that the Committee stand recessed until 30 minutes after adjournment of the Senate. Without objection, it was so ordered.

 

Senator Patrick reconvened the meeting at 1:30 PM.

 

At 1:30 PM Senator Robert Duncan assumed the chair. 

 

As a matter of pending business, the chair resumed invited testimony on SB 1724.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the invited testimony be closed; without objection, it was so ordered.

At 3:40 PM Senator Dan Patrick resumed the chair.

 

Senator Taylor requested unanimous consent to be shown voting aye on SB 132, SB 172, SB 401, SB 521, SB 573, and SB 715; there being no objection, it was so ordered.

 

There being no further business, at 3:40 PM Senator Dan Patrick moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
