Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Education was held on Tuesday, April 2, 2013, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 8:35 AM. The following business was transacted:

 

Pursuant to the suspension of Senate Rules 11.10 and 11.18 during the Senate session of

April 2nd, 2013, the chair considered the following bill, SB 1474.

 

Other Senators attending: Senator Wendy Davis.

 

At 8:36 AM Senator Royce West assumed the chair.

 

The chair laid out as a matter of pending business SB 1408 and recognized the author, Senator Patrick, to explain the bill.  The resource witness, Commissioner Michael L. Williams, is shown on the attached list.

 

At 8:39 AM the roll was called, and a quorum was present.

 

The chair moved that the testimony be closed; without objection, it was so ordered. 

 

Senator Royce West moved that SB 1408 be left pending; without objection, it was so ordered.

 

At 9:40 AM Senator Dan Patrick resumed the chair.

 

The chair laid out SB 1062 and recognized the author, Senator West, to explain the bill.  Senator Royce West sent up a committee substitute; the chair recognized Senator Royce West to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.

The chair laid out as a matter of pending business SB 929 and the proposed committee substitute sent up on Tuesday, March 26, 2013 and recognized the author, Senator Paxton, to explain the bill.  Senator Robert Duncan sent up Committee Amendment 1 to the proposed committee substitute and moved adoption; without objection, the amendment was adopted.  Senator Robert Duncan sent up Committee Amendment 2 to the proposed committee substitute and moved adoption; without objection, the amendment was adopted.  Senator Ken Paxton requested unanimous consent to incorporate the adopted amendments into the proposed substitute to create a new committee substitute; without objection, it was so ordered. Senator Ken Paxton then moved that the new committee substitute be adopted; without objection, it was so ordered. Senator Ken Paxton moved that SB 929 do not pass but that CSSB 929 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 1 nays, 0 present not voting, and 1 absent.       

 

As a matter of pending business, the chair opened public testimony on SB 1298. Witnesses testifying and registering on the bill are shown on the attached list.

Senator Royce West moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.
