Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Finance was held on Tuesday, May 7, 2013, in the Capitol Extension, Room E1.036, at Austin, Texas.

The chair called the meeting to order at 10:10 AM. The clerk called roll. There being a quorum present, the following business was transacted:

 

Senator Williams moved to suspend Rule 9 of the Senate Finance  Committee Rules so that the Committee could take up the subcommittee reports before the 24 hour layout period. Without objection, it was so ordered.

 

 

 

Senator Hinojosa assumed the chair.

 

The subcommittee report on SB 14 was laid out by Senator Williams. Senator Williams was recognized to explain the subcommittee report on SB 14.

 

Senator Williams sent up a committee substitute; the chair recognized Senator Williams to explain the difference between the committee substitute and the senate bill as filed. Senator Hinojosa moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Williams moved that SB 14 do not pass but that CSSB 14 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 10 ayes, 3 nays, 1 present not voting, and 1 absent.

 

The subcommittee report on SB 1648 was laid out by Senator Williams. Senator Williams was recognized to explain the subcommittee report on SB 1648.

 

Witnesses testifying and registering on the bill are shown on the attached list.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Williams moved that SB 1648 do not pass but that CSSB 1648 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 13 ayes, 0 nays, 0 present not voting, and 2 absent.

 

Senator Williams moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

Senator Williams resumed the chair.

 

The subcommittee report on SB 1494 was laid out by Senator Hinojosa. Senator Hinojosa was recognized to explain the subcommittee report on SB 1494.

 

Senator Hinojosa sent up Committee Amendment 1 and Committee Amendment 2.

 

Witnesses testifying and registering on the bill are shown on the attached list.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

The bill was left pending.

 

Senator Patrick submitted a motion in writing asking to be shown voting aye on SB 14 and SB 1648. There was no objecton.

 

Senator Lucio submitted a motion in writing asking to be shown voting aye on SB 1648. There was no objection.

 

Senator Estes submitted a motion in writing asking to be shown voting aye on SB 14. There was no objection. 

 

At 10:53 AM Senator Williams moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.

 

At 1:34 PM the Committee reconvened.  The posting rule, Senate Rule 11.10 and 11.18, was suspended for the Committee to meet at Senator Hinojosa’s desk to refer bills to the Subcommittee on Fiscal Matters. Senator Hinojosa assumed the chair. 

 

The following bills were referred to the Subcommittee on Fiscal Matters:  HB 78, HB 213, HB 294, HB 316, HB 317, HB 561, HB 671, HB 697, HB 800, HB 826, HB 1287, HB 1310, HB 1348, HB 1487, HB 1903, HB 1913, HB 2202, HB 2387, HB 2451, HB 2684, HB 2766 and HB 3572.

 

There being no further business, at 1:35 PM Senator Hinojosa moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
