Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Subcommittee on Fiscal Matters was held on Monday, April 29, 2013, in the Betty King Committee Room at Austin, Texas.

The chair called the meeting to order at 1:40 PM. There being a quorum present, the following business was transacted:

 

The chair laid out as a matter of pending business SB 100 by Senator Patrick.

 

Senator Nelson sent up a committee substitute; the chair explained the difference between the committee substitute and the senate bill as filed. Senator Hegar moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Hegar moved that SB 100 do not pass but that CSSB 100 be reported back to the Senate Committee on Finance with the recommendation that it do pass and be printed. The motion carried with a record vote of 3 ayes, 2 nays, 0 present not voting, and 0 absent.

 

The chair laid out as a matter of pending business SB 140 by Senator Ellis.

 

Senator Lucio, Jr. sent up a committee substitute; the chair recognized Senator Ellis to explain the difference between the committee substitute and the senate bill as filed. Senator Hegar moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Lucio, Jr. moved that SB 140 do not pass but that CSSB 140 be reported back to the Senate Committee on Finance with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 0 nays, 0 present not voting, and 0 absent.

 

The chair laid out as a matter of pending business SB 594 by Senator Deuell. 

 

Senator Hegar moved that SB 594 do not pass but that CSSB 594 be reported back to the Senate Committee on Finance with the recommendation that it do pass and be printed. The motion carried with a record vote of 3 ayes, 2 nays, 0 present not voting, and 0 absent.

 

The chair laid out as a matter of pending business SB 781 and recognized the author, Senator Hinojosa, to explain the bill.

 

Senator Hegar moved that SB 781 be reported favorably to the Senate Committee on Finance with the recommendation that it do pass and be printed. The motion carried with a record vote of 4 ayes, 1 nay, 0 present not voting, and 0 absent.

 

The chair laid out as a matter of pending business SB 1136 by Senator Hinojosa.

 

Senator Hegar moved to reconsider the vote by which the committee substitute was adopted. Without objection, it was so ordered. Senator Hegar moved to pull down the committee substitute.

 

Senator Hegar sent up a committee substitute; the chair recognized Senator Hinojosa to explain the difference between the committee substitute and the senate bill as filed. Senator Hegar moved adoption of the committee substitute; without objection, it was so ordered.    

 

Senator Hegar moved that SB 1136 do not pass but that CSSB 1136 be reported back to the Senate Committee on Finance with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 0 nays, 0 present not voting, and 0 absent.

 

The chair laid out as a matter of pending business SB 1494 and recognized the author, Senator Hinojosa, to explain the bill.

 

Senator Lucio, Jr. moved that SB 1494 do not pass but that CSSB 1494 be reported back to the Senate Committee on Finance with the recommendation that it do pass and be printed. The motion carried with a record vote of 3 ayes, 2 nays, 0 present not voting, and 0 absent.

 

The chair laid out as a matter of pending business SB 1685 by Senator Zaffirini.

 

Senator Lucio, Jr. moved that SB 1685 do not pass but that CSSB 1685 be reported back to the Senate Committee on Finance with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 0 nays, 0 present not voting, and 0 absent.

 

There being no further business, at 1:51 PM Senator Hegar moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
