Pursuant to suspension of Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Criminal Justice was held on Wednesday, May 15, 2013, at Senator Whitmire's Desk.

The chair called the meeting to order at 1:40 PM. There being a quorum present, the following business was transacted:

 

As a matter of pending business, the chair laid out HB 1020.

 

Senator Huffman moved that HB 1020 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent. Senator Patrick submitted a motion in writing requesting to be shown voting aye on HB 1020. Senator Hinojosa requested to be shown voting with the chair.

 

Senator Huffman moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

As a matter of pending business, the chair laid out HB 1318.

 

Senator Schwertner moved that HB 1318 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent. Senator Patrick submitted a motion in writing requesting to be shown voting aye on HB 1318. Senator Hinojosa requested to be shown voting with the chair.

 

As a matter of pending business, the chair laid out  CSHB 1349.

 

Senator Huffman moved that HB 1349 do not pass but that CSHB 1349 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 1 nay, 0 present not voting, and 1 absent. Senator Hinojosa requested to be shown voting with the chair.

 

As a matter of pending business, the chair laid out HB 2268.

 

Senator Schwertner sent up a committee substitute; the chair recognized Senator Whitmire to explain the difference between the committee substitute and the house bill as engrossed. Senator Schwertner moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Schwertner moved that HB 2268 do not pass but that CSHB 2268 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent. Senator Patrick submitted a motion in writing requesting to be shown voting aye on CSHB 2268. Senator Hinojosa requested to be shown voting with the chair.

Senator Hinojosa requested to be shown voting with the chair.

 

Senator Schwertner moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.
