Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Health & Human Services was held on Tuesday, February 12, 2013, in the Senate Chamber.

The chair called the meeting to order at 9:00 AM.

 

At 9:03 AM Senator Nichols assumed the chair.

 

The chair laid out as a matter of pending business SB 149 and recognized the author, Senator Nelson, to explain the bill.

 

Senator Nelson moved to withdraw the committee substitute to SB 149 sent up during the February 5, 2013 hearing. There being no objection, it was so ordered.

 

Senator Nelson sent up a committee substitute; the chair recognized Senator Nelson to explain the difference between the committee substitute and the senate bill as filed.

 

Senator Huffman sent up Committee Amendment 1 and moved that the amendment be left pending awaiting the arrival of a quorum. 

 

Senator Schwertner sent up Committee Amendment 2 and moved that the amendment be left pending awaiting the arrival of a quorum.

 

Upon arrival of a quorum, Senator Nelson moved the adoption of Committee Amendment 1, there being no objection it was so ordered. Senator Nelson moved adoption of Committee Amendment 2, there being no objection it was so ordered.

The chair laid out SB 406 and recognized the author, Senator Nelson, to explain the bill.

 

Senator Nelson sent up a committee substitute; the chair recognized Senator Nelson to explain the difference between the committee substitute and the senate bill as filed.

Upon arrival of a quorum, Senator Nelson moved adoption of the committee substitute for SB 406, there being no objection it was so ordered.

 

Senator Nelson moved that SB 406 do not pass but that CSSB 406 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 0 absent.

 

Senator Nelson moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

As a matter of pending business the chair laid out SB 149 and recognized Senator Nelson.

 

Senator Nelson requested unanimous consent to incorporate the amendments into a committee substitute; without objection, it was so ordered. Senator Nelson then moved that the committee substitute be adopted; without objection, it was so ordered. Senator Nelson moved that SB 149 do not pass but that CSSB 149 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 0 absent.
