Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Transportation was held on Wednesday, April 24, 2013, in the Capitol Extension, Room E1.016, at Austin, Texas.

The chair called the meeting to order at 8:01 AM. The following business was transacted:

 

The posting rule, Senate Rule 11.10 and 11.18, was suspended to hear the following bill(s):  HB 63.

 

The chair laid out HB 63 and recognized the Senate sponsor, Senator Zaffirini, to explain the bill.  Senator Paxton sent up a committee substitute; the chair recognized Senator Zaffirini to explain the difference between the committee substitute and the house bill as engrossed. 

Witnesses testifying and registering on the bill are shown on the attached list. 

 

The roll was called, and a quorum was established.

 

Testimony continued.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Nichols moved that HB 63 and its proposed committee substitute be left pending; without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 1350. The chair recognized Senator West, to explain a proposed committee substitute.  Senator Nichols moved that SB 1350 and its proposed committee substitute be left pending; without objection, it was so ordered.

 

The chair announced that the Committee would likely reconvene after the adjournment of the Senate to consider pending business. 

 

At 9:11 AM Senator Nichols moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.

 

Upon an adopted motion by Senator Nichols to suspend Senate Rules 11.10 and 11.18, the Senate Transportation Committee reconvened at 12:56 PM, at Senator Nichols’s Desk to consider pending business.

The roll was called, and a quorum was re-established.

The chair laid out as a matter of pending business SB 854.  Senator Paxton moved to pull down a committee substitute sent up at a previous hearing; without objection, it was so ordered. Senator Paxton sent up a new committee substitute. Senator Paxton moved adoption of the new committee substitute; without objection, it was so ordered. Senator Paxton moved that SB 854 do not pass but that CSSB 854 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 0 absent.  Senator Watson moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 1350.  Senator Watson moved to pull down a committee substitute sent up at a previous hearing; without objection, it was so ordered. Senator Watson sent up a new committee substitute.  Senator Watson moved adoption of the new committee substitute; without objection, it was so ordered.  Senator Watson moved that SB 1350 do not pass but that CSSB 1350 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 0 absent. 

 

The chair laid out as a matter of pending business SB 1488.  Senator Watson moved to pull down a committee substitute sent up at a previous hearing; without objection, it was so ordered. Senator Watson sent up a new committee substitute.  Senator Watson moved adoption of the new committee substitute; without objection, it was so ordered.  Senator Watson moved that SB 1488 do not pass but that CSSB 1488 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 4 nays, 0 present not voting, and 0 absent. 

 

There being no further business, at 1:05 PM Senator Nichols moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
