Amend the Rose amendment to CSHB 1 in Article V of the bill (page 202 of the amendment packet) by striking the text of the original amendment and adding the following appropriately numbered rider following the appropriations to the Juvenile Justice Department (pages V-23 through V-25) and renumbering subsequent riders accordingly:
____. Appropriation Transfers Between State Operated Facilities Strategies and Probation Strategies. Notwithstanding any limitation on transfer authority prescribed by this Act, the Juvenile Justice Department may transfer appropriations from a strategy supporting state operated facilities to a strategy supporting juvenile probation services, if the department determines that state operated facilities will not require the entire appropriation for the fiscal year because state operating populations have declined. Beginning September 1, 2015, if a transfer is made in a quarter, the department shall report to the Legislative Budget Board the amount of funds transferred in that quarter on or before the last day of the quarter. If no transfer is made in a quarter, the department shall report to the board what factors resulted in the decision not to transfer funds.
