Amend CSHB 1 as follows:
(1) On page III-18, amend the following rider:
66. Foundation School Program Funds for Improving Equity, Reducing Recapture, and Increasing State Share. Included in amounts appropriated above in Strategy A.1.1., FSP - Equalized Operations, is $1,108,100,000 in each fiscal year of the 2016-17 biennium out of the Foundation School Fund No. 193 to be allocated to school districts and charter schools through formula or other changes to the Foundation School Program to be determined by the Eighty-Fourth Legislature for the purposes of improving equity, reducing recapture, and increasing the state share of the Foundation School Program.
Contingent on the enactment of legislation related to expansion of or increasing quality standards for prekindergarten programs and modification of the Foundation School Program entitlement formula to incorporate such legislation by the Eighty-Fourth Legislature, Regular Session, and from amounts appropriated above and directed by this rider, the Texas Education Agency shall allocate $1,000,000 in fiscal year 2016 and $300,000,000 in fiscal year 2017 from the Foundation School Fund No. 193. This contingency is satisfied if the prekindergarten program established by the enacted legislation commences at any time during the 2016-17 biennium. The Texas Education Agency shall use the fiscal year 2016 appropriation to establish the administration of the program that is the subject of such legislation.
The Commissioner of Education shall determine the amount required to implement the provisions of the legislation in fiscal year 2017. In the event it is determined by the Commissioner that the amount required to implement the provisions of the legislation is less than $300,000,000 in fiscal year 2017, no later than June 1, 2016, the Commissioner of Education shall increase the basic allotment for fiscal year 2017 by the amount determined, in cooperation with the Legislative Budget Board, to be available within the excess appropriations allocated by this rider.
