Amend CSHB 1 (house committee printing) in Article V by striking Rider 13 following the appropriations to the Alcoholic Beverage Commission (page V-4) and substituting the following appropriately numbered rider:
____. Contingent Rider for SB 1198 or HB 3104. Contingent on the enactment of SB 1198, HB 3104, or similar legislation of the 84th Legislature, Regular Session, 2015, that becomes law, amending the tied house laws to authorize alcoholic beverage license and permit holders and their affiliates to have certain ownership interests in more than one tier of the alcoholic beverage industry, out of the amounts appropriated above to the Texas Alcoholic Beverage Commission in Strategy C.1.1, Compliance Monitoring, the amount of $301,297 in fiscal year 2016 and $288,967 in fiscal year 2017 shall be allocated to the commission to fund any additional costs the commission incurs in conducting any investigation of the holdings of an applicant for or holder of a license or permit that is necessary to ensure compliance with tied house laws as amended by SB 1198, HB 3104, or similar legislation of the 84th Legislature, Regular Session, 2015. The allocation made by this rider is contingent upon the commission assessing or increasing surcharges sufficient to generate, during the 2016-17 biennium, $590,264 in additional revenue.
