Amend CSHB 1 (house committee printing) by adding the following appropriately numbered rider in Article IX of the bill as follows:
Sec. 7.____. Annual Reporting on Increased Utilization of Historically Underutilized Businesses and Distribution of Contracts Among Historically Underutilized Businesses.
(a)(1)  It is the intent of the legislature that the University of Houston shall, at a minimum, make a good faith effort to seek to increase its Historically Underutilized Businesses (HUB) contracting at a range of at least 10 percent to 20 percent, in each of the procurement categories when the institution establishes its HUB goals.
(2)(a)  It is the intent of the legislature that the University of Houston appropriated funds under this Act report to the Comptroller of Public Accounts, the members of the House Appropriations and Senate Finance Committee, Speaker of the House, Lieutenant Governor, and the Legislative Budget Board, by December 31, 2015, the university's efforts to comply with this section. An institution shall also make an annual report of its findings by December 31st for each fiscal year of the 2016-17 biennium.
(b)  When seeking to attain the increased HUB goal under Subsection (a)(1) of this section, it is the intent of the legislature that the University of Houston shall make a good faith effort to give greater priority to each subcategory of economically disadvantaged person, as named under Section 2161.001(3)(A)(i) through Section 2161.001(3)(A)(vi), Government Code, for which the university has awarded less than 30 percent of HUB contracts - as measured by total dollars spent for contracts with all HUBs between Fiscal Years 2010 to 2014.
(c)  It is the intent of the legislature that the University of Houston shall, in addition to the requirements of Section 2161.123 of the Texas Government Code, make a good faith effort to add to the university's strategic plan, at a minimum, the following:
(1)  strategy for contracting with new HUB vendors in order to expand its HUB base;
(2)  provide an ethnic breakdown of women certified HUB contracts;
(3)  not make any decreases to the number of HUB contracts that were previously awarded;
(4)  provide guidelines for enforcement of the HUB program;
(5)  identify any discriminatory practices or marketplace barriers that adversely affect contract participation by HUB;
(6)  develop programs to remedy or reduce the effects of any identified discriminatory practices or marketplace barriers that adversely affect contract participation of HUB; and
(7)  provide a detailed summary of its HUB outreach efforts, which includes requiring prime contractors to document their outreach efforts and provide reasons why prime contractors may have rejected qualified HUB that were the low-bidding subcontractors.
(d)  It is the intent of the legislature that the University of Houston shall, when developing the strategic plan under Subsection (c) of this section, give priority to an economically disadvantaged person, as defined by Section 2161.001(3), of the Texas Government Code, whose average percentage of total dollars spent with HUB between Fiscal Years 2010 to 2014 is less than 20 percent.
