Amend CSHB 91 (house committee printing) on page 2, by striking lines 15 through 18 and substituting the following:
Sec. 435.0062. RAW MILK TESTING; RECORD OF TEST RESULTS. (a) At least twice each month, a producer of raw milk shall submit for testing the raw milk to a laboratory accredited by the United States Food and Drug Administration. The testing must include tests for:
(1) the total aerobic bacterial count;
(2) the total coliform count; and
(3) the somatic cell count.
(b) Raw milk may not be sold unless the results of the testing conducted under Subsection (a) indicate:
(1) a total aerobic bacterial count of less than 20,000 colony-forming units per milliliter in milk derived from cattle or goats;
(2) a total coliform count of less than 10 colony-forming units per milliliter in milk derived from cattle or goats; and
(3) a somatic cell count of less than:
(A) 750,000 per milliliter in milk derived from cattle; and
(B) 1 million per milliliter in milk derived from goats.
(c) A producer of raw milk shall ensure that the results of the testing conducted under Subsection (a) are sent to the department by:
(1) the laboratory on completion of the testing; or
(2) the producer not later than the fifth day after the date the producer receives the testing results.
(d) A producer of raw milk shall keep each record of testing required under this section until the first anniversary of the testing date.
(e) The department on request shall provide a copy of the record of the results of testing conducted under this section or from an inspection of raw milk conducted under Section 435.004 or 435.005.
