Amend HB 311 (introduced version) as follows:
(1) On page 2, lines 20-21, between "RECORDING." and "Notwithstanding", insert "(a)".
(2) On page 2, line 24, between the period and "Extrinsic", insert "(b)".
(3) On page 2, line 26, after the period, insert the following:
The extrinsic evidence does not affect the rights of a creditor or a subsequent purchaser who has paid valuable consideration and who does not have notice of the executory contract.
