Amend CSHB 655 (house committee report) as follows:
(1) In SECTION 1 of the bill, in amended Section 11.153(b)(1), Water Code (page 1, line 23), strike "Subchapter G, Chapter 27, and Subchapter N, Chapter 36" and substitute the following:
:
(A) Subchapter G, Chapter 27, and Subchapter N, Chapter 36; or
(B) if the project is located in a groundwater conservation district that has adopted rules for the regulation of aquifer storage and recovery projects that have been approved by the commission under Section 36.452, the rules adopted by the district
(2) In SECTION 2 of the bill, in added Subchapter G, Chapter 27, Water Code (page 3, lines 7-9), strike added Section 27.152 and substitute the following:
Sec. 27.152. REGULATION OF ASR INJECTION WELLS. The commission may regulate and permit ASR injection wells in any area in which a groundwater conservation district has not adopted rules for the regulation of aquifer storage and recovery projects that have been approved by the commission under Section 36.452.
(3) In SECTION 3 of the bill, in added Subchapter N, Chapter 36, Water Code, between added Sections 36.451 and 36.452 (page 7, between lines 16 and 17), insert the following:
Sec. 36.452. APPLICABILITY; RULES. (a) A district may adopt rules for the regulation of aquifer storage and recovery projects. Rules adopted under this subsection do not take effect until the commission by order approves the rules.
(b) Sections 36.453 through 36.457 apply to a district only if:
(1) the district has not adopted rules for the regulation of aquifer storage and recovery projects; or
(2) the commission has issued an order disapproving rules adopted by the district for the regulation of aquifer storage and recovery projects.
(4) Renumber the subsequent sections of added Subchapter N, Chapter 36, Water Code, accordingly.
