Amend HB 996 (house committee printing) as follows:
(1) On page 2, between lines 2 and 3, insert the following:
(b-1) Notwithstanding Subsection (b)(1), an institution of higher education may require a person bidding on a public work contract, including a contractor or subcontractor, to enter into or adhere to an agreement with a collective bargaining organization relating to the public work contract if the person is not insured and bonded.
(2) On page 2, immediately following added Section 2269.0541(a), Government Code, insert the following:
(a-1) Notwithstanding Subsection (a)(1), a governmental entity may require a person bidding on a public work contract, including a contractor or subcontractor, to enter into or adhere to an agreement with a collective bargaining organization relating to the public work contract if the person is not insured and bonded.
