Amend CSHB 1110 (house committee printing) as follows:
(1) On page 2, line 1, strike "the" and substitute "any".
(2) On page 2, line 2, strike "or".
(3) On page 2, line 5, between "convention" and the underlined period, insert the following:
if the legislature made an application to call the convention; or
(C) exceeds the scope or subject matter of the Article V convention if the legislature did not make an application to the United States Congress to call the convention".
(4) On page 2, line 7, strike "shall" and substitute "may".
(5) On page 3, line 1, strike "two delegates and two alternate delegates" and substitute "three delegates and three alternate delegates".
(6) On page 3, between lines 4 and 5, add the following appropriately lettered subsections to added Section 393.052, Government Code, and reletter other subsections of that section and cross-references to those subsections accordingly:
( ) If the legislature is unable to appoint delegates and alternate delegates under Subsection (a) at least 30 days before the date an Article V convention is scheduled to begin, the governor, lieutenant governor, and speaker of the house of representatives shall each appoint one delegate and one paired alternate delegate to the convention.
( ) If the number of delegates allocated to represent the state is fewer than three and the legislature is unable to appoint the delegates and alternate delegates under Subsection (a) at least 30 days before the date an Article V convention is scheduled to begin, the governor shall appoint all delegates and alternate delegates to the convention.
(7) On page 3, line 8, between "legislature" and "shall", insert "or appointing officer, as applicable,".
(8) On page 4, line 5, between "convention" and the underlined comma, insert "or an amendment outside the scope of this convention if the Texas Legislature did not make an application to the United States Congress to call this convention".
(9) On page 4, line 13, strike "shall" and substitute "may".
(10) On page 4, line 16, between "instructions" and "that", insert "for an Article V convention called following an application by the legislature to the United States Congress for the convention".
(11) On page 4, lines 19 and 20, strike "to the United States Congress to call the Article V" and substitute "for the".
