Amend CSHB 1455 (house committee report) as follows:
(1) On page 2, lines 2 through 3, strike "at least 67" and substitute "more than 50".
(2) On page 2, line 3, strike "in the association" and substitute "allocated under the declaration".
(3) On page 2, line 4, between "a" and "special", insert "regular, annual, or".
(4) On page 2, lines 6 through 12, strike added Section 82.119(c), Property Code.
(5) Reletter the remaining subsections of added Section 82.119, Property Code, and correct cross-references to those subsections accordingly.
(6) On page 2, line 25, strike "special".
(7) On page 3, line 6, strike "special".
(8) On page 4, between lines 11 and 12, insert the following new subsection, appropriately lettered, and reletter the subsections of proposed Section 82.119, Property Code, accordingly:
( ) The period of limitations for filing a suit or initiating an arbitration proceeding for a claim described by Subsection (b) is tolled until the first anniversary of the date the procedures are initiated by the association under that subsection if the procedures are initiated during the final year of the applicable period of limitation.
(9) On page 4, line 24, strike "claim based on an act or omission that occurs" and substitute "suit filed or arbitration proceeding initiated".
(10) On page 4, lines 25 through 26, strike "claim based on an act or omission that occurred" and substitute "suit filed or arbitration proceeding initiated".
