Amend CSHB 1704 (house committee report) as follows:
(1) On page 1, strike lines 18-20, and substitute the following:
SECTION 2. Section 102.003, Family Code, as amended by SB 219, Acts of the 84th Legislature, Regular Session, 2015, is amended by amending Subsection (a) and adding Subsection (d) to read as follows:
(2) On page 3, line 12, between "(15)" and "a person", insert "subject to Subsection (d),".
(3) On page 3, between lines 15 and 16, insert the following:
(d) A person described by Subsection (a)(15) has standing to file an original suit only if:
(1) the person is filing an original suit jointly with the other intended parent under the gestational agreement; or
(2) the person is filing an original suit against the other intended parent under the gestational agreement.
