Amend Amendment No. 1 by Gonzales to CSHB 2493 as follows:
(1) On page 1, strike lines 13 through 18.
(2) On page 1, line 21, strike "45, and 46" and substitute "45, 46, and 47".
(3) On page 2, between lines 2 and 3, insert the following:
Sec. 47. REPRESENTATION BY ATTORNEY GENERAL. The attorney general may assess and collect from the Commissioner or the Board reasonable attorney's fees associated with any legal representation requested by the Commissioner and provided by the attorney general. Notwithstanding any other law, a requirement that the attorney general represent an agency in any litigation does not apply to a proceeding under this Act that is governed by Chapter 2001, Government Code.
(4) Add the following appropriately numbered items to the amendment:
(____) On page 10, strike lines 19 through 21, and substitute the following appropriately numbered SECTION of the bill:
SECTION ____. Subsections A and D, Section 35, The Securities Act (Article 581-35, Vernon's Texas Civil Statutes), are amended to read as follows:
(____) On page 11, between lines 18 and 19, insert the following:
D. A cost incurred by the Board in administering or enforcing this Act may be paid only from a fee collected under Subsection A of this section.
(____) On page 11, line 23, strike "Subsections C and D" and substitute "Subsection C".
(5) Renumber the items of the amendment as appropriate.
