Amend CSHB 2977 (house committee report) by adding the following appropriately numbered SECTION to the bill and renumbering subsequent SECTIONS of the bill accordingly:
SECTION ____. Subchapter A, Chapter 311, Transportation Code, is amended by adding Section 311.009 to read as follows:
Sec. 311.009. COUNTY REQUEST FOR CLOSING OF ALLEY IN CERTAIN MUNICIPALITIES. (a) This section applies only to a municipality with a population of more than 10,000 but less than 25,000 that has land area of less than four square miles and is located wholly within a county that has a population of more than 2.3 million and a total area of less than 1,000 square miles.
(b) If not otherwise restricted by a county, a municipality that receives a request for the abandonment of an alley located in any portion of the county shall, not later than the 30th day after the date the request was submitted, issue a final decision to grant or deny the request.
(c) A request for which a final decision is not issued in the period described by Subsection (b) is considered to be granted.
(d) A decision of the municipality under Subsection (b) may be appealed to a district or county court.
