Amend HB 3424 (house committee printing) as follows:
(1) On page 1, line 8, strike "The" and substitute "(a) Except as provided by Subsection (b), the [The]".
(2) On page 1, between lines 16 and 17, insert the following:
(b) The clerk of a court must obtain the consent of a guardian of an incapacitated person on a form prescribed by the Department of Public Safety of the State of Texas before the clerk may provide to the department the information for the incapacitated person described by Subsection (a).
(3) On page 2, line 16, between "persons" and the underlined semicolon, insert "who have a guardian consenting to the dissemination of the incapacitated person's information under Section 1053.106, Estates Code".
