Amend CSSB 11 (senate committee report) as follows:
(1) In SECTION 1 of the bill, in added Section 411.2031(c), Government Code (page 1, line 40), strike "Except as provided by Subsection (d) or (e)," and substitute "Except as provided by Subsection (d), (d-1), or (e),".
(2) In SECTION 1 of the bill, in added Section 411.2031, Government Code (page 1, between lines 50 and 51), insert the following:
(d-1) An institution of higher education may establish rules, regulations, or other provisions prohibiting license holders from carrying handguns on premises that are owned or leased and operated by the institution and located on the campus of the institution only if a majority of the students at the institution vote to approve the rules, regulations, or other provisions.
(3) In SECTION 3 of the bill, in amended Section 411.208(a), Government Code (page 2, lines 28-30), strike "an institution of higher education, an officer or employee of an institution of higher education," and substitute "an institution of higher education that has not adopted rules under Section 411.2031(d-1), an officer or employee of an institution of higher education that has not adopted rules under Section 411.2031(d-1),".
(4) In SECTION 3 of the bill, in amended Section 411.208(b), Government Code (page 2, lines 43-44), strike "an institution of higher education, an officer or employee of an institution of higher education," and substitute "an institution of higher education that has not adopted rules under Section 411.2031(d-1), an officer or employee of an institution of higher education that has not adopted rules under Section 411.2031(d-1),".
(5) In SECTION 3 of the bill, in added Section 411.208(d)(1), Government Code (page 2, lines 54-56), strike "an institution of higher education, an officer or employee of an institution of higher education," and substitute "an institution of higher education that has not adopted rules under Section 411.2031(d-1), an officer or employee of an institution of higher education that has not adopted rules under Section 411.2031(d-1),".
(6) Add the following appropriately numbered SECTION to the bill and renumber subsequent SECTIONS of the bill accordingly:
SECTION ____. Section 30.06(e), Penal Code, is amended to read as follows:
(e) It is an exception to the application of this section that the property on which the license holder carries a handgun is owned or leased by a governmental entity and is not:
(1) a premises or other place on which the license holder is prohibited from carrying the handgun under Section 46.03 or 46.035; or
(2) an institution of higher education that has adopted rules under Section 411.2031(d-1), Government Code.
