AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Barbers and cosmetologists often offer their services to participants who are preparing for a special event, such as a wedding. There is concern, however, that provision of these services at a location other than a licensed facility could be problematic under the law. It is noted that offering such services at a place other than a licensed facility would better serve clients. H.B. 104 seeks to amend the applicable law to address this concern.

 

H.B. 104 amends current law relating to the practice of barbering and cosmetology at certain events.

 

RULEMAKING AUTHORITY

 

Rulemaking authority is expressly granted to the Texas Commission of Licensing and Regulation in SECTION 3 of this bill.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 1601.455(b), Occupations Code, as follows:

 

(b)  Authorizes a person holding a license, certificate, or permit under this chapter to perform a service within the scope of the license, certificate, or permit at a location other than a licensed facility for a client:

 

(1)  creates this subdivision from existing text; or

 

(2)  in preparation for and at the location of a special event, including a wedding.

 

SECTION 2.  Amends Section 1602.407(b), Occupations Code, as follows:

 

(b)  Authorizes a person holding a license, certificate, or permit under this chapter to perform a service within the scope of the license, certificate, or permit at a location other than a licensed facility for a client:

 

(1)  creates this subdivision from existing text; or

 

(2)  in preparation for and at the location of a special event, including a wedding.

 

SECTION 3.  Requires the Texas Commission of Licensing and Regulation to adopt rules to implement Sections 1601.455(b) and 1602.407(b), Occupations Code, as amended by this Act, not later than December 1, 2015.

 

SECTION 4.  Effective date: September 1, 2015.
